Terms of Service

1. Acceptance

By accessing vixpulse.asia (the "Service"), you agree to be bound by these Terms of Service (the "Terms") and any policies referenced herein. These Terms constitute a legally binding agreement between you and Beach & Wne Co. ("we", "us"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally able to access and use the Service in your jurisdiction. You are responsible for ensuring that your use of the Service complies with your local laws.

3. Services

VIX Pulse is a software product publishing daily VIX-tier US-equity decision-support reports developed by the company.

All software output is provided for informational purposes only and does not constitute investment advice or a solicitation to buy or sell any financial instrument.

4. Acceptable Use

You agree not to:

• scrape, crawl, or otherwise extract content, alerts, or data from the Service without authorisation;
• circumvent any access control;
• use the Service in violation of any applicable law in your jurisdiction.

5. Intellectual Property

All content on the Service (including text, charts, algorithms, trademarks, and UI design) is the property of the company or its licensors and is protected by copyright and other intellectual-property laws. No rights are granted other than the limited rights of use expressly stated in these Terms.

6. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. To the maximum extent permitted by law we disclaim all warranties regarding the accuracy, timeliness, or completeness of any content, or any investment outcomes derived from publicly traded US securities and VIX-tier framework output.

7. Limitation of Liability

To the maximum extent permitted by law, the company, its directors, employees, and contractors shall not be liable for any indirect, incidental, consequential, punitive, or special damages (including but not limited to lost profits, trading losses, loss of data, or loss of goodwill), whether based on contract, tort, or any other legal theory. Our total aggregate liability in connection with the Service is limited to the amount you actually paid us in the preceding twelve (12) months.

8. Indemnification

You agree to indemnify and hold harmless the company from and against any claim, damage, loss, liability, cost, or expense (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any third-party right.

9. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including 5, 6, 7, 8, and 10) will continue in force.

10. Governing Law & Jurisdiction

These Terms and any dispute arising out of them are governed by the laws of Taiwan (R.O.C.), without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the courts of Taiwan New Taipei District Court.

11. Changes

We may update these Terms from time to time. Material changes will be posted on this page and, for existing subscribers, notified by email. Continued use of the Service constitutes acceptance of the updated Terms.
